1. The agreement

These Terms & Conditions ("Terms") are a binding agreement between you and GymGo("we," "us"), 2450 Industrial Pkwy, Hayward, CA 94545. They apply to your use of this website and to every order you place, together with our Privacy Policy, Return Policy, Shipping Information and Warranty terms, which are incorporated by reference. If you order on behalf of a business, you represent that you are authorized to bind it.

2. Products, conditions & pricing

• Condition labeling. Every listing states whether equipment is new or remanufactured. Remanufactured machines are rebuilt used equipment restored to like-new mechanical condition and close-to-new cosmetic condition; minor cosmetic variation from photos may occur.
• Pricing and errors. Prices are in US dollars and may change without notice. We work hard on accuracy, but if a listing contains an obvious pricing or description error, we may cancel affected orders and refund in full rather than fulfill at the erroneous price.
• Availability. Remanufactured inventory is often one-of-a-kind. If a unit becomes unavailable after you order, we'll offer an equivalent machine, a rebuild of the same model, or a full refund.
• Compare-at prices reflect the manufacturer's list price or typical new-equipment price for the equivalent model and are provided for comparison only.

3. Orders & payment

• Your order is an offer to purchase; it is accepted when we confirm and begin processing. We may decline or cancel orders for suspected fraud, pricing errors or shipping restrictions, with a full refund of amounts paid.
• Payment is due at order unless you purchase on approved terms, an invoice, or through a financing or leasing partner. Financing is subject to the lender's separate agreement.
• Deposits on custom-finished or multi-unit orders are stated on your quote and become non-refundable once custom work begins, as described in the Return Policy.
• You are responsible for providing accurate shipping and contact information; costs caused by inaccurate information (re-delivery, storage, re-consignment) may be charged to you.

4. Shipping, delivery & risk of loss

• Processing and transit estimates are good-faith estimates, not guaranteed dates. See Shipping & Delivery for service levels and what each includes.
• For domestic shipments, we retain risk of loss until delivery, provided you follow the delivery-inspection procedure: note damage on the delivery receipt and report it within 48 hours. Signing a clean receipt limits our ability to recover freight claims on your behalf.
• Missed delivery appointments, refused non-damaged deliveries, and inaccessible delivery sites may incur carrier re-delivery or storage fees, which are your responsibility.
• International orders ship under the freight terms stated on your quote (door-to-port or EXW); title and risk transfer per those terms, and import duties, taxes and destination charges are the buyer's responsibility.

5. Returns & warranty

Returns are governed by the Return Policy (30-day window, 15% restocking fee, custom orders non-returnable). Warranty coverage is governed by the Warranty page — manufacturer warranties on new equipment and the GymGo 1-year parts & labor warranty (extendable) on remanufactured equipment. Those documents state the exclusive remedies for returned or defective equipment.

6. Acceptable use & intellectual property

• You may use this site to browse and purchase equipment for lawful purposes. You may not scrape at disruptive volume, attempt to breach security, misrepresent your identity, or interfere with other users.
• All site content — text, product photography, graphics, logos and the GymGo name — is owned by us or our licensors and protected by copyright and trademark law. Manufacturer names and marks belong to their respective owners and are used to identify compatible genuine products.
• Content you submit (reviews, photos) may be used by us to operate and promote the store; you confirm you own it and grant us a non-exclusive, royalty-free license to use it.

7. Disclaimers & limitation of liability

Exercise equipment is inherently strenuous to use and heavy to move. Consult a physician before beginning any exercise program, follow the manufacturer's manual, and use qualified help — or our installation service — for moving and assembly.

Except for the express warranties described on the Warranty page, the site and products are provided "as is" and we disclaim all other warranties, express or implied, including merchantability and fitness for a particular purpose, to the extent permitted by law. To the same extent, our total liability for any claim arising from an order is limited to the amount you paid for the affected equipment, and we are not liable for indirect, incidental or consequential damages such as lost profits or gym downtime. Some states do not allow certain limitations, so portions of this section may not apply to you.

8. Disputes & governing law

These Terms are governed by the laws of the State of California, without regard to conflict of law rules. Before filing any claim, you agree to contact us and give us 30 days to resolve the issue informally — in our experience that solves nearly everything. Any dispute that can't be resolved informally will be brought in the state or federal courts located in Alameda County, California, and both parties consent to their jurisdiction. Either party may pursue small-claims court instead where eligible.

9. General provisions

• Changes. We may update these Terms; the version posted at the time you place an order governs that order. The effective date above reflects the current version.
• Severability. If any provision is found unenforceable, the rest remain in effect.
• No waiver. Our not enforcing a provision is not a waiver of it.
• Entire agreement. These Terms and the incorporated policies are the entire agreement between us regarding the site and your orders.
