Terms of Service

1. Overview

This site is operated by Twister Gym Bus, Inc. (EIN 65-0919162), a US-based retailer of new and remanufactured commercial gym equipment, with its warehouse at3100 NW Boca Raton Blvd #308, Boca Raton, FL 33431. "We", "us" and "our" refer to Twister Gym Bus, Inc.. These Terms work together with our Shipping & Delivery Policy, Returns & Refund Policy, Payment Methods, Warranty and Privacy Policy, which are incorporated by reference.

2. Eligibility & use of the site

You confirm you are at least 18 years old and will not use our products or site for any unlawful purpose. If you order on behalf of a business, you confirm you are authorized to bind it. Breach of these Terms terminates your access immediately.

We may refuse service to anyone for any lawful reason at any time. Non-sensitive content may be transmitted unencrypted; payment data is always encrypted. You may not reproduce, copy, sell or exploit any part of the site without our written permission.

3. Pricing & orders

All prices are in US dollars ($) and may change without notice. Placing an order is an offer to buy; a binding sale is formed only when we accept your order and confirm payment. Standard liftgate freight is free across the continental United States; delivery elsewhere, white-glove installation ($350 per machine) and applicable sales tax are shown on your invoice. Orders paid by bank wire or ACH are released for delivery once funds clear. Financing is subject to the lender's separate agreement.

4. Products & availability

Every listing states whether equipment is new or remanufactured. Photos and dimensions are representative and individual units may vary cosmetically. Remanufactured inventory is often one-of-a-kind and may sell before your order is processed; if so, we will offer a comparable unit or a full refund. Compare-at prices reflect the manufacturer's list price or typical new price and are for comparison only. We may limit sales by geography, customer type or quantity, and may modify or discontinue any product at any time.

5. Delivery & site access

Orders are typically handled in 1–3 business days and in transit for 3–7 business days; these are estimates, not guaranteed dates. You are responsible for making sure the delivery address is accessible to a freight truck, for providing accurate contact details so the carrier can schedule delivery, and for any building, HOA or landlord approvals needed to receive and install equipment. If the driver cannot access the site, an appointment is missed, or redelivery is needed because of site conditions, additional freight charges may apply. See the Shipping & Delivery Policy.

6. Title & risk of loss

Title to and risk of loss for equipment pass to you on delivery to the address you provide. You or your authorized representative must be present to inspect and accept the shipment, note any damage on the delivery receipt, and email us photos within 24 hours. International orders ship under the terms stated on your quote.

7. Returns & refunds

Delivered, undamaged equipment may be returned within 30 days of delivery under a Return Authorization, subject to a restocking fee of up to 25% and return freight at your expense. Custom-finished, special-order, modified and installed or in-service equipment is not eligible. A 10% service fee may apply if you request a refund without having followed the freight or site-access terms for an order. Full details are in our Returns & Refund Policy.

8. Warranty

New equipment carries the manufacturer's warranty and remanufactured equipment carries theTwister Gym Bus warranty described on the Warranty page. Except for those warranties and any warranty that cannot be excluded by law, equipment is sold "as is" and all other warranties, express or implied — including merchantability and fitness for a particular purpose — are disclaimed.

9. Errors, inaccuracies & site information

Site content is provided for general information. We are not responsible if information is inaccurate, incomplete or outdated, and you use it at your own risk. We may correct errors in pricing, descriptions or availability and cancel affected orders after submission; if an order is cancelled after payment, you receive a full refund.

10. Prohibited uses

• Unlawful purposes, or soliciting others to perform unlawful acts;
• Violating any federal, state or local law;
• Infringing our intellectual property or anyone else's — site text, photography, logos and the Twister Gym Bus name belong to us or our licensors; manufacturer marks belong to their owners;
• Harassment, abuse, defamation or discrimination;
• Submitting false or misleading information;
• Uploading malware or interfering with site security;
• Scraping or collecting other users' personal information.

11. Disclaimers & limitation of liability

Exercise equipment is strenuous to use and heavy to move. Consult a physician before starting an exercise program, follow the manufacturer's manual, and use qualified help or our white-glove installation for moving and assembly.

The site is provided "as is" and "as available"; we do not warrant uninterrupted, error-free or secure operation. Subject to applicable law, our aggregate liability is capped at the amount you paid for the order giving rise to the claim, and we are not liable for indirect, incidental, special, punitive or consequential damages, including lost profits, revenue, data or facility downtime. Nothing in these Terms limits consumer-protection rights that cannot be waived.

You agree to indemnify and hold Twister Gym Bus, Inc. and its officers, directors, employees and agents harmless from any claim arising out of your breach of these Terms or your violation of any law or third-party right.

12. Governing law

These Terms are governed by the laws of the United States and the State of Maine, without regard to conflict-of-law rules. Disputes that cannot be resolved through good-faith discussion will be brought before the state or federal courts located in Androscoggin County, Maine. Either party may use small-claims court where eligible.

13. General

• Severability. If any provision is found unenforceable, the remainder stands.
• Termination. Either party may terminate this agreement by notice; obligations incurred before termination survive.
• Entire agreement. These Terms and the policies on this site are the entire agreement between you and Twister Gym Bus, Inc.. Failure to enforce a provision is not a waiver of it.
• Changes. We may update these Terms by posting changes here. Continued use after changes are posted constitutes acceptance; the version posted when you order governs that order.
